02 — ServicesMERGVS provides immersive digital property marketing services, including but not limited to: interactive 3D environments and spatial computing experiences, architectural photography, cinematic video production, drone footage, floor plan production, and virtual staging. Full service descriptions are available at mergvs.com/services.
Service scope, deliverables, timelines, and commercial terms are defined in individual engagement agreements or statements of work entered into between MERGVS and each client. In the event of conflict between these Terms and a specific engagement agreement, the engagement agreement prevails.
03 — Agent PartnershipsMERGVS operates a commission-based partnership model for licensed estate agents and brokers. Agents who submit a property listing receive a digital partnership agreement via DocuSign within 24 hours. Production begins at MERGVS risk upon agreement execution. Fees are settled at transaction closing, invoiced within 14 days of completion.
Partnership terms do not create an exclusivity arrangement. Agents retain all obligations to their clients under applicable professional regulations.
04 — Intellectual PropertyAll creative output produced by MERGVS — including 3D environments, photography, video, and spatial experiences — remains the intellectual property of MERGVS until full payment is received, at which point a licence or assignment of rights is granted as specified in the engagement agreement.
All website content, brand assets, editorial content, and software on mergvs.com are the exclusive property of MERGVS S.à r.l. and are protected by copyright and applicable intellectual property law. You may not reproduce, distribute, modify, or create derivative works without prior written consent.
05 — Client ObligationsClients and users agree to:
MERGVS provides services with reasonable skill and care. To the fullest extent permitted by applicable law, MERGVS excludes all implied warranties, conditions, and representations not expressly stated in an engagement agreement.
MERGVS shall not be liable for: indirect, incidental, or consequential loss; loss of revenue, profit, or data; or any loss arising from reliance on content published on this website. MERGVS's total aggregate liability for any claim arising from services provided shall not exceed the total fees paid by the client for the relevant engagement.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded by law.
