Terms of service

01Acceptance of terms

By accessing or using the MERGVS website (mergvs.com) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, you must not use our website or services. These Terms apply to all visitors, clients, partner agents, and any other users.

MERGVS is a studio working from Luxembourg City, Milan and Istanbul. For anything else, use the contact form.

02Description of services

MERGVS provides immersive digital property marketing services, including but not limited to: interactive 3D environments and spatial computing experiences, architectural photography editing, video rendered from the 3D model, floor plan production, and virtual staging. Full service descriptions are available at mergvs.com/services.

Service scope, deliverables, timelines, and commercial terms are defined in individual engagement agreements or statements of work entered into between MERGVS and each client. In the event of conflict between these Terms and a specific engagement agreement, the engagement agreement prevails.

03For estate agents and brokers

Licensed estate agents and brokers commission the same three production bands as any other client, at the same fees. Agents who submit a property listing receive a written quote, usually within 24 hours, naming the band, its contents, the delivery date and the payment schedule.

Half of the fee falls due when production starts and half on publication, payable within 14 days of invoice. There is no monthly fee and no exclusivity arrangement, and nothing obliges an agent to commission a second listing. Where a listing is withdrawn after production has started, the first instalment is treated as earned and the remainder is quoted against the work completed.

Agents retain all obligations to their clients under applicable professional regulations.

04Ownership of content

All creative output produced by MERGVS, including 3D environments, photography, video and spatial experiences, remains the intellectual property of MERGVS until full payment is received, at which point a licence or assignment of rights is granted as specified in the engagement agreement.

All website content, brand assets, editorial content, and software on mergvs.com are the exclusive property of MERGVS and are protected by copyright and applicable intellectual property law. You must not reproduce, distribute, modify, or create derivative works without prior written consent.

05Your responsibilities

Clients and users agree to:

• Provide accurate and complete information when submitting enquiries or entering into agreements.
• Ensure they hold all necessary rights and permissions for property access required for production.
• Not use MERGVS services or deliverables for any unlawful purpose or in breach of third-party rights.
• Not misrepresent MERGVS materials in any manner that could mislead buyers, sellers, or the public.

06Liability and warranties

MERGVS provides services with reasonable skill and care. To the fullest extent permitted by applicable law, MERGVS excludes all implied warranties, conditions, and representations not expressly stated in an engagement agreement.

MERGVS shall not be liable for:

• indirect, incidental or consequential loss,
• loss of revenue, profit or data,
• any loss arising from reliance on content published on this website.

The total aggregate liability of MERGVS for any claim arising from services provided shall not exceed the total fees paid by the client for the relevant engagement.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded by law.

07Acceptable use of this website

Use this website for lawful purposes only. You must not:

• Attempt to gain unauthorised access to any part of the website or its underlying systems.
• Introduce malicious software, viruses, or any disruptive material.
• Use automated tools to scrape, copy, or extract content without written permission.
• Transmit unsolicited commercial communications via any contact mechanism on this site.

09Jurisdiction and governing law

These Terms are governed by the laws of the Grand Duchy of Luxembourg. Any disputes arising from these Terms or from use of the website shall be subject to the exclusive jurisdiction of the courts of Luxembourg City, unless mandatory consumer protection law in your jurisdiction provides otherwise.

10Amendments to these terms

MERGVS reserves the right to update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
